Third Appellate Win
Laura wins Shadle v. Kailash Development case in August 2008. 3-0 record!
Issue: Whether a developer's affirmative defenses to a quiet title action bar a claim of adverse possession for land within the developer's preliminary plat of a subdivision. The Court held, "Because resolution of a claim for adverse possession is not within the scope of the statutory definintion of a "land use decision" and there is no basis of equitable estoppel here, we affirm."
Second Appellate Win
Laura wins Cutter vs. The Estate of Devereaux
Plaintiff sued Estate claiming he was a surviving spouse entitled to an undivided half interest in all community property. The Court of Appeals concluded that the trial court properly determined that no meretricious relationship existed between Cutter and Devereaux and affirmed the Trial Court's Orders.
